Aspire Performance & Nutrition
These Terms of Service ("Terms") govern your access to and use of Aspire Performance & Nutrition (the "Platform"), including our website, subscription content, interactive tools, courses, and printable materials (collectively, the "Services"). The Platform is owned and operated by Luke Rodriguez, MS, RDN ("Aspire," "we," "us," or "our") in Colorado.
By accessing or using the Services, creating an account, or purchasing a subscription, you agree to these Terms. If you do not agree, do not use the Services.
1.1 Binding Agreement. These Terms form a legally binding agreement between you and Aspire.
1.2 Eligibility. You must be at least 18 years old to create or manage an Aspire account. A parent, legal guardian, or other adult responsible for the household must manage household access used by a minor. Coaches manage program-level access only and do not manage a household runner account or its private data.
1.3 Authority. If you are using the Services on behalf of a school, team, organization, or other entity, you represent you have authority to bind that entity to these Terms.
2.1 Educational Platform. Aspire provides general sports nutrition education for high school track & field and cross country coaches, athletes, and parents, including articles, interactive tools, season playbooks, and topic resources. Written by a sports dietitian (MS, RDN) who head-coaches high school cross country. Aspire publishes a deliberately small launch library. The live parent under-fueling guide states its limits and cites the research it uses; the operational guides do not claim clinical proof.
2.2 General Platform Content and Private 1:1 Care. Self-serve website content, accounts, tools, courses, articles, and handouts provide general education and do not independently create Medical Nutrition Therapy ("MNT") or a dietitian–client relationship. A separately purchased private 1:1 service may include individualized nutrition assessment, counseling, and MNT within the registered dietitian's scope and is governed by its own intake, consent, documentation, and follow-up process. See Section 12 (Medical Disclaimer).
2.3 Food-First Approach. Aspire's content and tools provide food-based educational recommendations and do not prescribe supplements or individualized calorie prescriptions.
2.4 Household Kitchen. An eligible adult-managed household can search the released recipe catalog, choose recipe yields, and assemble a grocery checklist. Web Kitchen selections remain in account-scoped local browser storage and mobile selections remain on the device. Recipes are household ideas, not individualized plans, calorie or macro targets, allergen certifications, diagnoses, or treatment. Users must verify labels, substitutions, allergies, storage, and cross-contact.
2.5 Held Runner Planning. Runner Fuel Profile, calculated runner planning, profile-linked week and race planning, and related health or screening workflows are not part of the current release. Historical records from earlier internal or test workflows may remain until an adult deletes them, but current release routes do not expose their create, read, or update functions.
2.6 College Recruiting Research. Aspire provides school, team, cost, contact, published-standard, and development research plus family-managed planning tools. Fit labels are screening and comparison aids, not promises or probabilities. Aspire does not guarantee recruitment, admission, eligibility, roster placement, financial aid, or a scholarship offer, and the official school, governing body, coach, admissions office, and financial-aid office control those decisions.
2.7 Private Parent Support. Eligible Parent Access households may use one private household thread for general sports-nutrition education and help using Aspire resources. Only the signed-in adult-managed household and authorized Aspire administrators may open the thread. Do not submit names, contact details, dates of birth, school identifiers, exact lab values, or emergency requests. The thread is not individualized assessment, diagnosis, treatment, supplement dosing, medical clearance, or emergency care.
3.1 Account Registration. To access certain features, you may be required to create an account. You agree to provide accurate information and to keep it updated.
3.2 Account Security. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
3.3 Users Under 18. Users under 18 may not create or manage an account. A parent, legal guardian, or other adult responsible for the household must create and manage the household account and supervise the minor's use. A coach may share general educational resources and a program code, but may not create or manage the minor's household account or access private runner data. Aspire does not ask minors to provide separate account credentials or date of birth through public signup.
3.4 Children Under 13. The Services are not directed to children under 13, and children under 13 may not create accounts or submit personal information to Aspire. If we learn that we collected personal information directly from a child under 13 without the authorization required by law, we will delete it and disable the associated access as appropriate.
4.1 What Aspire Sells. Aspire offers the following, and prices are subject to change with the price shown at the time of purchase controlling that purchase:
4.1.1 Recruiting Source-Clearance Hold. Aspire is not offering new Recruiting Access purchases, and ranking-backed school, directory, comparison, development, and roster-continuity access is suspended, while the written source-clearance release gate is incomplete. The cost and scholarship planner may remain available because it does not publish the held ranking dataset. This hold does not silently cancel an existing subscription or change its disclosed renewal, cancellation, or refund terms; those remain governed by Sections 4.3 through 5.3 unless Aspire separately confirms a billing change. An existing subscriber who cannot use purchased access during the hold should contact Aspire for account-specific assistance and any remedy required by applicable law.
4.1.2 Retired Plans. The $119/year and $14/month Parent Access subscriptions are closed to new purchases. If you hold one, it continues on its existing terms until the end of the term you paid for, and sections 4.3 through 4.7 and 5.1 through 5.2 continue to apply to it.
4.2 Payment Processor. Payments are processed through third-party payment providers (e.g., Stripe). You agree to the processor's terms as applicable.
4.3 Renewal. Card subscriptions, including monthly and annual Recruiting Access, renew automatically with the renewal terms disclosed at checkout and may be canceled anytime before the renewal date. Invoice, purchase order, and check accounts do not renew automatically; they receive renewal reminders, and renewal requires the appropriate school approval. One-time purchases — Parent Access terms, 1:1 visits, and 1:1 season packages — never renew and are never charged again without a new purchase you make yourself.
4.4 Billing Cycles. Annual plans are charged once for a twelve-month term beginning on the day the purchase completes. Monthly plans, where one still applies to an account, are charged once per month on the same day of the month as the original purchase; where a month has no matching day, the charge falls on the last day of that month. One-time purchases are charged once, on the day the purchase completes, and there is no billing cycle. The amount, and the interval where one applies, are shown on the checkout page before you pay and in the receipt afterwards. Card subscriptions are managed in the Stripe billing portal linked from your account page.
4.5 Taxes. Prices are shown exclusive of sales or use tax. Where Aspire is required to collect tax, it is calculated at checkout based on the billing address you supply and is added to the amount charged. If your school or district is tax-exempt, tell us before purchase and send the exemption certificate; we cannot refund tax already collected on a completed card purchase, but we can apply the exemption to subsequent terms.
4.6 Price Changes. The price shown at the time of purchase applies for the full term you bought. A price change never applies retroactively or mid-term. If the price of your plan changes before a renewal, the new price applies only from that renewal onward, and you may cancel before the renewal date if you do not want to continue at the new price.
4.7 Failed Payments. If a renewal payment fails, the payment processor retries the charge according to its standard schedule and your access continues while those retries run. If the charge is still unpaid after the retry period ends, the subscription lapses and paid access ends — for Program Access this also ends Parent Access for the school's roster families. Updating the card in the billing portal restores access without a new purchase. Invoice, purchase order, and check accounts are not retried automatically; access continues to the end of the term already paid for and renewal requires the appropriate school approval.
5.1 Cancel Anytime (Monthly). You may cancel a monthly subscription at any time; cancellation takes effect at the end of the current billing period.
5.2 Annual Plans. Annual subscriptions remain active through the end of the annual term unless otherwise required by law.
5.2.1 One-Time Purchases. A Parent Access term, a 1:1 first visit, and a 1:1 season package are charged once and have nothing to cancel. Parent Access runs for exactly 120 elapsed days from the completed purchase and does not renew automatically. Unused 1:1 season-package sessions carry to the following season for the same athlete as described in 4.1.
5.3 Refund Policy. Aspire does not offer a satisfaction guarantee, a money-back guarantee, or a trial period on any plan or service. Except where required by law, fees are non-refundable, including partially used billing periods, a season already begun, and unused 1:1 sessions. Cancelling a subscription stops the next renewal; it does not refund the term already paid for. If you believe you were charged in error, contact Aspire and we will look at it.
5.4 Termination by Aspire. We may suspend or terminate your access if you violate these Terms, misuse the Platform, or engage in fraudulent or unlawful conduct.
You agree to use the Services only for lawful purposes. Parent, Athlete, and Recruiting Access are limited to one household. You may not share your login credentials or allow persons outside your household to access your account; doing so is a material breach and may result in termination of access without refund. You may not: share or resell access except as expressly allowed under Program Access; copy, reproduce, distribute, or create derivative works; attempt to reverse engineer, scrape, or disrupt the Platform; upload malware or attempt unauthorized access; or use the Platform to provide medical advice or represent that Aspire content is medical guidance.
You may enter operational information into released tools and keep Household Kitchen choices in local browser or device storage. Submitting information to a self-serve tool does not by itself create a dietitian–client relationship; a separate private 1:1 engagement may establish that relationship through its intake and consent process. Software guardrails do not replace an authorized adult's review or qualified medical and nutrition care. You retain ownership of your inputs and grant Aspire a limited license to use information actually submitted to its servers to operate and improve the Services. Aspire does not sell personal data for monetary consideration.
All content is owned by Aspire or its licensors. You receive a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, educational purposes. You may not reproduce, distribute, publicly display, or create derivative works except as permitted.
The Services are provided "AS IS" and "AS AVAILABLE." Aspire disclaims all warranties, express or implied. We do not guarantee uninterrupted access or error-free operation.
Aspire will not be liable for indirect, incidental, special, consequential, or punitive damages. Total liability will not exceed the amount you paid in the 12 months before the event (or $100 if you have not paid anything).
You agree to indemnify and hold harmless Aspire from any claims arising from your misuse of the Services, violation of these Terms, or violation of any law or third-party rights.
Self-serve Platform content and the private Parent Support thread provide general sports nutrition education and are not medical advice, diagnosis, or treatment. A private 1:1 professional engagement may provide individualized nutrition care within the registered dietitian's scope, but it does not replace physician evaluation or emergency care. Using a public resource or Parent Support thread does not establish that relationship. Always seek qualified physician advice regarding medical conditions. Do not use the Platform, Parent Support thread, or 1:1 messaging for emergencies. Call 911.
Tool outputs are educational estimates and planning ranges, not prescriptions when used on their own. When a registered dietitian shares or reviews a tool during a private 1:1 engagement, the separate consult note and direct follow-up instructions define the individualized plan. Food-first education only; no guaranteed race protocol. Athletes vary; appetite, tolerance, access, growth, recovery, symptoms, and qualified care take priority. Physician visit prep reports are intended to help organize questions—not medical advice.
Program Access covers one school's cross country and track & field programs, boys and girls, and grants authorized user accounts to the school's head and assistant coaches during the license term. The school or program may designate an admin to manage staff access. Program Access includes Parent Access for participating roster families through the active program code; standalone Parent Access remains the offering for households outside a participating school. Accounts may not be shared outside the covered program.
